MATTER OF #ENDSARS ACTIVIST, AYO ADEMILUYI, BONAFIDE LABOUR PARTY  CANDIDATE FOR ETI-OSA HOUSE OF REPS AND OTHERS GET TO SUPREME COURT

The matter of AYODELE ADEMILUYI & ORS v LABOUR PARTY & INEC in which the  bonafide candidate of the Labour Party for Eti-Osa Federal Constituency , AYODELE ADEMILUYI and other bonafide Federal House of Representatives' candidates of the Labour Party  are seeking judicial orders to be so published as Candidates of the Party by INEC  has reached the Supreme Court.

It will be recalled that AYODELE ADEMILUYI, a leading #EndSARS Activist and Co-Counsel to the #EndSARS Protesters  emerged as Candidate of the Labour Party for Eti-Osa Federal Constituency, the Constituency where the Lekki Massacre occurred  at the May 27th , 2022 Primary of the Labour Party , held within the period allowed for same by the Electoral Act(2022 as amended).

However, both the national leadership of the Labour Party and the Independent National Electoral Commission refused and neglected to publish his name and other bonafide candidates. This caused him and his colleagues to institute an action at the Federal High Court, Lagos Division, FHC/L/CS/1187/2022 ABIODUN DABIRI & ORS v LABOUR PARTY & INEC which was before Justice Ringim before they withdrew voluntarily.

It is important to state that their voluntary withdrawal is premised on the hand of peace stretched out by the National Legal Adviser of the Labour Party, Akingbade Oyenekan who instructed AYODELE Ademiluyi,who is also a legal practitioner to institute an action in the name of the Labour Party and 11 other bonafide candidates , including himself. This is the sublime truth despite the false denial of Akingbade Oyenkan , which have been evidentially refuted.

Hence , the suit, FHC/L/CS/1920/22 , LABOUR PARTY & 11 ORS v INEC was instituted and was heard by Justice Aneke of the Federal High Court, Lagos Division. 

On the day set down for judgment in the matter thereof, Honourable Justice Aneke informed the bonafide Candidates in the suit FHC/L/CS/1920 of a similar suit, FHC/L/CS/2178/2022 , LABOUR PARTY & 12 ORS v INEC seeking the same reliefs.

Processes were exchanged and it was at this point that the bonafide candidates that the Plaintiffs in 2178 are self parading
 " substitution candidates" who have been refused by INEC and who refuse to reveal the persons they are "substituting" to the Court.

As matters were panning out before Justice Aneke, the bonafide candidates got wind of a Court of Appeal judgment in which another set of Appellants, claiming to be "Candidates" wherein the Labour Party was  granted orders of the Court to have their names inputed into INEC website.

Aggrieved of the decision of the Court of Appeal, the bonafide candidates have appealed by way of Intervener Appeal to the Supreme Court seeking that the Supreme Court interplead the Judgment of the Court of Appeal in their names. 

The battle line is drawn. The struggle for a political voice for the #EndSARS movement would be fought to conclusion.
